Please note that there is no warranty on second hand goods. The warranty only applies to the original purchaser: we cannot transfer that warranty as we do not know how that product has been treated. However, if you have purchased a second hand Active 10, you can send it in for a General Service and we will endeavour to ensure the unit is returned to you thoroughly tested, repaired if necessary and upgraded where applicable. (Please note: there may be charges for components used)
This Limited Warranty (Warranty) is granted by Satmap Systems Ltd (SSL), of 4 Fountain House, Cleeve Road, Leatherhead, Surrey, KT22 7LX, to the purchaser, from new, of SSL Hardware products, strictly for private use only.
Cover provided by this Warranty: Satmap Systems Ltd (SSL) warrants that the Hardware will be free from defects in workmanship and materials, under conditions of normal use, for a Warranty Period of two (2) years. The Warranty Period takes effect from the date the Hardware was purchased by you as new, from an approved and authorized retailer or distributor. During the Warranty Period, the Hardware will be repaired or, at the discretion of SSL, replaced with new Hardware, at no cost to you for either labour or parts. If the Warranty Period has expired, the repair undertaken will be subject to a new Warranty, lasting for a period of six (6) months from the date of the repair, and at a cost to you determined by SSL.
Exclusions from this Warranty: This Warranty only applies to Hardware products: no warranties are provided for the Software. For information on all Software products, including pre-installed Software, please refer to supporting document, including the EULA. This Warranty does not apply to normal wear and tear sustained in conditions of normal use, and therefore does not cover the repair or replacement of any product, or part thereof, resulting from abuse, misuse, misapplication, faulty operation and failure to comply with the instructions for use, including but not limited to the incorrect insertion of batteries, the use of incorrect battery types, the use of incorrect battery chargers, and the incorrect insertion of SD Cards, USB cables and headphones. The Warranty does not cover damaged sustained by accident, neglect, exposure to damaging liquids, abrasive substances, and extremes of heat. Physical damage to the surface of the Hardware and is not covered by this Warranty. Damage caused by the ingress of moisture, dust and dirt following the exposure of Hardware to these factors, or following the incorrect closure of the watertight seals on the SD Card door, USB door and battery compartment, is not covered by this Warranty.
Making a claim under Warranty: If during normal use you encounter a fault or Defect with the Hardware please contact SSL directly by telephone, in writing, or via the website to register and explain the Defect. You must return the Hardware, in accordance with the shipping and packing procedures as stipulated by SSL, within the Warranty period along with a clear explanation of the nature of the Defect, information on the date and point of purchase, and the circumstances in which it arose, to the address given on this Warranty for assessment and claim validation by SSL engineers. If a Defect that is a valid claim under the terms of this Warranty arises after the first ninety (90) days of the Warranty Period, SSL reserves the right to charge shipping and handling charges in respect of any remedial actions undertaken to resolve the claim.
a) This Warranty and any other addendum or amendment supplied either within the packaging or on the SSL website is the only express warranty made to you in respect of Hardware, and any other warranties are not binding on SSL. It only applies to goods purchased from new from approved and authorised distribution channels and it cannot be transferred to any other person (s).
b) Although SSL works hard to deliver high quality products, SSL does not warrant that the Hardware supplied is without errors in operation. To the maximum extent permitted by applicable law, SSL supplies the Hardware on the basis of 'as is' including any faults, and hereby disclaims all other warranties and conditions, whether express, implied or statutory, including, but not limited to, any implied warranties, duties or conditions of satisfactory quality or fitness for particular purpose, of reliability or availability, of accuracy, of a lack of viruses, with regard to all SSL products and those of their suppliers, including product information, support and services.
c) To the maximum extent permitted by law, no warranty is provided for the Software. It is supplied 'as is' including any faults. The entire risk as to satisfactory quality, performance, and accuracy is with you.
d) All Hardware and Software supplied by SSL is protected in full by copyrights, trademarks and patents owned by SSL and / or its suppliers and you or any other persons or organization (s), are not permitted to modify the Software or the Hardware under any circumstances. You will not, or permit any other person or organization to, engage in any activities aimed at dissembling the Software or Hardware, either in whole or in part, in order to analyse for any purposes, including attempts to undertake any reverse engineering, unauthorized modifications, or to make products derived from it. SSL reserves the right to discontinue, update or upgrade the services and products supplied to you or made available to you through the use of the SSL products, with or without notice.
e) Your attention is particularly drawn to the fact that the Hardware relies on the correct operation of the GPS satellite network, over which SSL has no control whatsoever as this is owned and operated by the Government of the United States of America.
f) SSL cannot accept any responsibility for any errors in third party Software products, including, but not limited to, map data. Any depiction of road, path, or track on mapping in the data is no indication of a right of way, and SSL and its suppliers exclude all liability for such depiction.
g) SSL cannot and does not warrant any Hardware or Software supplied as pre-used or bought as secondhand, or purchased as new from a non-authorised or non-approved distributor.
h) SSL products MUST NOT, under any circumstances, be used with any equipment other than that designed, developed or supplied by SSL. You expressly acknowledge that any attempts to do so may result in damage to some or all of the products involved, and may be dangerous.
i) If you should breach any of the terms and conditions of the Warranty it will be deemed to have expired on the date of such breach.
h) If any section or part thereof, of this Warranty is held to be void, illegal, invalid or unenforceable, the remaining terms of this Warranty shall remain in full force and effect.

a) To the maximum extent permitted by applicable law neither SSL nor its suppliers shall be liable to you or to any third party for any damages, direct, indirect or consequential arising out of the use, misuse, or inability to use the software or hardware, even if SSL, its suppliers or distributors have been advised of the possibility of such a claim. If you are unsure on the operation of the SSL products, you are strongly advised to read the Full User Guide (available at www.satmap.com or by post upon request), or contact your point of purchase for assistance, or go to SSL directly.
b) Notwithstanding any damages that you might incur for whatever reason, the liability of SSL and its suppliers pertaining to or arising this EULA from shall be limited to the amount actually paid by you for the products.
c) SSL shall not be liable for any fraud or fraudulent misrepresentation perpetrated by any of its employees of agents.
Export Restrictions: In accepting this Warranty, you acknowledge that the Software and Hardware are subject to export restrictions by the U.S and the European Union, and that you will comply with all applicable national and international laws in respect of the PRODUCTS including end-user, end-use and destination restrictions.
Governing Law: This EULA is governed by English Law and all disputes shall be settled exclusively in the courts of England. The terms of the UN Convention on Contracts for the International Sales of Goods are agreed by all parties to be excluded from this EULA.
